PERSONS WHO MAY ADOPT
The determination of who may become an adoptive parent is often made by an approved adoption agency by screening applicants and making placement. An approved agency must establish and make available written criteria for eligibility to adopt.
This requirement is specified in the New Jersey Administrative Code. Prospective adopting persons must have the capacity to meet the child’s physical and emotional needs and be of good physical and mental health.
The law mandates that an approved agency must use the best interests of the child as the standard in selecting adoptive parents. Furthermore, an agency may not discriminate with respect to the selection of adoptive parents for any child on the basis of age, sex, race, national origin, religion or marital status but these factors may be considered determining whether the best interest of the child are served by a particular placement or adoption.
Neither New Jersey law nor public policy prohibits joint adoption of a child by someone of the same sex as the birth parent. If a birth mother’s same sex partner petitions to adopt the birth mother’s child, the petition may be granted if it is in the child’s best interest.A petitioner's sexual orientation is a factor to be considered but it is dispositive only when it adversely affects the child.
